1. About Us

www.ebikebuyer.com is operated by Binty Trading Limited (“we”, “us”, “our”). We are registered in England and Wales (company number 11809375) and our registered office is 128 City Road, Kemp House, London, EC1V 2NX. 

2. These Terms

These terms and conditions (together with the documents referred to in them) (the “Terms”) set out the rules for using our website www.ebikebuyer.com (the “Website”) and the services provided through it (the “Services”).

These Terms apply whether you access the Services using a computer, mobile device, or any other method.

By using our Website, you confirm that you accept these Terms and agree to comply with them. If you do not agree, you must not use the Website or the Services. 

3. Definitions

In these Terms, the following words and phrases have the meanings set out below:

Approved Used: an e-Bike sold directly by us as “Approved Used”, which is condition graded and sold with the items and warranty stated in Section 12. 

Buyer: a person who purchases an e-Bike through the Website. 

Buyer Protection Period: the 48-hour period after delivery or collection during which a Buyer may raise a Dispute for “significantly not as described” items (see Section 10.2 and Section 11). 

Contract: an agreement for the sale/purchase of an e-Bike formed between Buyer and Seller (private listing), or between the Buyer and us (Approved Used), or between you and us where we buy your e-Bike under the Immediate Cash Option. 

Deposit: an initial payment we may pay to a Seller under the Guaranteed Sale option, later deducted from the total amount due. 

Dispute: a claim raised by a Buyer within the Buyer Protection Period that an e-Bike is “significantly not as described”. 

e-Bike: an electric bicycle listed or sold through the Website. 

Valuation: an estimated value shown on the Website based on the information provided and market data, which may be revised (see Section 9.1). 

Fees: the percentage fee deducted from sale proceeds for private listings (see Section 10.1). 

Guaranteed Sale Value: an option (available for certain brands/models) where we offer a guaranteed valuation figure, subject to inspection and the conditions in these Terms (see Section 10.3–10.5). 

Immediate Cash Price: an option (available for certain brands/models) where we offer to buy the e-Bike for an agreed cash price, subject to inspection and the conditions in these Terms. 

Inspection: checks carried out by us (and/or our workshop) to verify the e-Bike’s details, condition, and included items. 

Private Listing: a marketplace listing created on the Website for an e-Bike sold by a private Seller. 

Seller: a person who lists or sells an e-Bike through the Website. 

“Significantly not as described”: materially different from the listing description, assessed using the criteria set out in Section 11.2. 

4. Other Applicable Terms

The following policies also apply to your use of our Website:

  • Privacy Policy – explains how we process your personal data. By using the Website, you consent to that processing and confirm that the information you provide is accurate.
  • Cookie Policy – explains how cookies are used on our Website. 

5. Changes to These Terms

We may update these Terms at any time by amending this page. Updated Terms apply from the date they are posted. Continued use of the Website or Services means you accept the updated Terms. 

6. Permitted Use of Our Website

Our Website is designed for individuals or businesses who wish to sell an e-Bike on their own behalf to obtain a valuation and list and sell an e-Bike through our marketplace (and, for selected bikes, access Guaranteed or Immediate Cash options). 

To protect the Website and Services, you must not:

  • transmit anything designed to interrupt, damage, destroy, or limit the Website or Services;
  • attempt to gain unauthorised access to the Website, non-public areas, servers, databases, or systems connected to the Services;
  • use automated tools (including robots, crawlers, spiders, scraping tools, data-mining tools);
  • use the Website/Services to create, check, confirm, update, modify, or amend databases, records, or directories (yours or anyone else’s);
  • use the Website unlawfully, fraudulently, offensively, or abusively;
  • copy our data or reverse engineer any part of the Services or Website processes; or
  • interfere with any other user’s use or enjoyment of the Website or Services. 

7. Access to and Availability of Our Website

  • You are responsible for making the arrangements needed to access the Website and should use appropriate virus protection software.
  • Use of the Website is free of charge.
  • We do not guarantee that the Website, Services, or any content will always be available or uninterrupted, or that it will be free from bugs, errors, or viruses.
  • We may suspend, withdraw, discontinue, or change all or part of the Website (including access) at any time, for any reason, without notice. 

8. Links

You may link to publicly accessible pages of our Website provided the link is fair and legal and does not damage our reputation or suggest that we endorse or approve you or your website. We may require you to remove any link at any time and may withdraw linking permission at any time.

Where the Website includes links to third-party websites or resources, these are provided for information only. We do not control those websites and are not responsible for their content. 

9. Intellectual Property Rights

We own or license all intellectual property rights in the Website and the materials published on it. These works are protected by copyright and related laws worldwide, and all rights are reserved. 

You may print one copy and download extracts of pages for your personal use. You must not:

  • modify any printed or downloaded materials; or
  • use any illustrations, photographs, video/audio sequences, or graphics separately from accompanying text. 


PART A — SELLING THROUGH eBikeBuyer


10. Our Selling Service (Agent Relationship)

We act as an agent for you (the principal) as the owner of the used e-Bike. We provide a listing service and act as an intermediary between you and the Buyer. For selected brands/models, we may also offer a Guaranteed Sale Value or Immediate Cash option. 

10.1 Valuation

Any Estimated Valuation generated on the Website is based on:

  • the information you provide about the e-Bike; and
  • historic sales/market data.

You can amend details during the valuation process. If false or misleading information is provided (including condition, history, unusual features, or customisation), the valuation may change and/or any offer may be revised. If your e-Bike is currently available brand new for a lower price than the original purchase price, we reserve the right to use the lower figure in order to provide a valuation. 

11. Private Seller Listings (for Sellers)

11.1 Seller Responsibilities

If you choose a Private Seller Listing, you are responsible for ensuring the listing information is accurate and honest. You set the asking price and buyers may submit offers for you to review. You can accept, decline, or make counter-offers.

Listings remain active for 90 days, or until:

  • the e-Bike is sold; or
  • you tell us the e-Bike is no longer available (whichever happens first). 

11.2 Selling Fees

It is free to list your e-Bike on our website. We operate a tiered selling fee based on the final sale value. Fees are deducted from the amount paid to you: 

  • Less than £1,000 — 14%
  • £1,000–£1,500 — 13% 
  • £1,500–£2,500 — 12% 
  • £2,500 or more — 11% 
  • Guaranteed Option — no fees or charges 
  • Immediate Cash Option — no fees or charges 

11.3 Buyer Protection Period 

Buyers have 48 hours after collection or delivery to inspect the e-Bike and raise a Dispute if it is “significantly not as described”.

If a Dispute is raised within this period:

  • we will pause the Order and investigate; and 
  • we will work with the Buyer and Seller to find a resolution. 

If a resolution is not possible:

  • we will cancel the Order; and 
  • the e-Bike will be returned to the Seller. 

If there is evidence of mis-selling by the Seller, the Seller is responsible for any return shipping costs. 

11.4 Guaranteed Sale Value / Immediate Cash Option

Where you select the Guaranteed Sale Value or Immediate Cash option:

  • we will arrange collection and delivery to our workshop; and 
  • we will inspect the e-Bike and verify the information you provided. 

If the e-Bike’s value is affected by anything not apparent from the information you provided (including history, condition, unusual features, customisation, damage, missing items, or anything affecting the assumptions made in the valuation), the valuation/offer may be revised downwards. 

11.5 How We Pay You

Private listing:
We process payment (net of Fees) by bank transfer 48 hours after the Buyer has received the e-Bike, unless a Dispute is raised. Funds normally clear 2–3 working days after processing. If a valid Dispute is raised, payment may be delayed. If the Order is cancelled, the e-Bike will be returned to you. 

Guaranteed sale option:
You will receive an initial Deposit after successful Inspection. The e-Bike will then be listed and, when sold, you will receive the guaranteed valuation amount, less any Deposit already paid. If the e-Bike is not sold within 45 days, you will automatically receive the guaranteed valuation amount, less any Deposit already paid. Funds normally clear 2–3 working days after processing

Immediate cash option:
We process payment immediately after successful Inspection. If you have already received a Deposit, it will be deducted from the total payment. Once you receive funds under the immediate cash option, the e-Bike is considered sold. Funds normally clear 2–3 working days after processing

11.6 Price Guarantee

Subject to our Inspection, the Valuation is guaranteed for 7 days from the date we sent it to you. 

11.7 Ownership

Title and ownership of any e-Bike listed remains with you (the original owner) until it is sold. You may request return of your e-Bike at any time, subject to any applicable cancellation charges. 

11.8 Hand-over Requirements

When a Contract is formed, you must provide us and/or the Buyer with:

  • all copies of the e-Bike keys (if applicable); 
  • proof of purchase (if requested); 
  • the e-Bike’s service history (if any); and 
  • user manuals (if any). 

You must remove all personal belongings from the e-Bike. We are not responsible for personal items once the e-Bike is in our or the Buyer’s possession.

If you fail to comply, we may withdraw any offer to buy the e-Bike, terminate the Contract, and/or provide a revised Price. If we rescind the Contract, we will return the e-Bike to you and you must refund any Price paid to you. 

11.9 Transaction Fees

There are no transaction fees. 

11.10 Payment Options

Payments to sellers are made by bank transfer only following successful Inspection (where applicable). Events beyond our control may delay payment and we are not liable for the delay. 

11.11 Cleaning

To ensure timely Inspection and payment, e-Bikes must be reasonably clean. If an e-Bike arrives heavily soiled, we reserve the right to charge a £40 cleaning fee, deducted from the final payment. 

11.12 Time Limits

If you select the Guaranteed Sale Value or Immediate Cash option, the e-Bike must be shipped to us within 10 days of approval of registration. The shipping date is the date the courier collection is arranged. Bikes shipped after this may be subject to re-valuation. 

11.13 Cancellation

If you have sent your e-Bike to us but it has not sold and you wish to cancel, we can return it to you. We charge £99.99 to cover return shipping, packaging, and the initial courier collection cost.

If you received an initial payment, it must be returned before we dispatch the e-Bike back to you. If you opted for early payment and received funds under the Immediate Cash option, the e-Bike is considered sold and cannot be returned. 


PART B — BUYING THROUGH eBikeBuyer


12. Private Listings 

Private listings are created by Sellers and are not quality-checked by us. However, we verify ownership and cross-check frame numbers against stolen bike registers. Our Buyer Protection applies where an item is misrepresented or not as described, subject to the conditions below. 

12.1 Refunds and Cancellation

If an Order has been placed but collection has not yet been arranged with our couriers, we can cancel and issue a full refund.

Once the courier collection has been arranged, the Order cannot be cancelled or returned unless:

  • it is “significantly not as described”; and 
  • this is reported to us by raising a Dispute within the 48-hour Buyer Protection Period. 

After the Buyer Protection Period ends, cancellations and refunds are not permitted. 

12.2 Disputes and Returns

If an item significantly differs from the listing description, the Buyer may be entitled to a full refund, including delivery charges.

Valid Dispute reasons include:

  • wrong frame size; 
  • wrong colour (not including minor shade differences); 
  • wrong brand/make; 
  • wrong model; 
  • different frame material; 
  • different model year; 
  • different specifications; 
  • significantly different condition; 
  • major flaws not mentioned in the description e.g. faulty battery/motor; 
  • counterfeit product or components; 
  • missing parts/components; or 
  • significant damage not described or shown in photos. 

What are not considered valid dispute reasons include:

  • colour differences caused by lighting, wear, or camera settings;
  • minor differences in condition;
  • the frame size not being suitable (unless inaccurately described); or
  • change of mind. 

12.3 How to Raise a Dispute

Contact us within the Buyer Protection Period and provide the reasons for the Dispute. We will pause the Order while we investigate. If we determine the Dispute is valid and resolution is not possible, we will arrange return to the Seller and refund the Buyer in full (including delivery charges) once the Seller has received the item.

The validity of Disputes is determined at the sole discretion of eBikeBuyer. 

12.4 Delivery

Fully assembled delivery is available to mainland UK addresses. For remote parts of Scotland, Northern Ireland, the Channel Islands, and other offshore islands, additional charges may apply and delivery may be partially assembled in a box. Seller approval may be required.

Delivery is usually within 4–7 working days (depending on Seller availability). We will notify you if delivery will take longer. 

12.5 Warranty Terms

No warranty is provided for private listings. 


PART C — APPROVED USED SALES


13. Used Electric Bike Sales (Approved Used)

Approved Used e-Bike's are quality checked and graded by condition. They include the battery, mains charger, battery keys (if applicable), and a 12-month warranty as standard. 

13.1 Refunds and Cancellation (Cooling-Off)

You may cancel your order within 14 days of receiving the goods. If you cancel within this period, you are entitled to a full refund within 14 days after we have received back the returned item and it has completed the return inspection. 

Goods must be returned to Binty Trading Ltd. The Buyer is responsible for returning goods, including appropriate packaging and courier insurance (if used). We can arrange collection, but this is at an additional cost. 

13.2 Delivery

Delivery is available to mainland UK addresses. For remote areas (including parts of Scotland, Northern Ireland, Channel Islands and offshore islands), additional charges may apply and delivery may be partially assembled. Contact us before ordering to confirm any charges.

Delivery is usually within 3–5 working days for stock items. We will notify you if delivery will take longer. 

13.3 Proof of Identity and Address

To prevent fraud, we may require:

  • original valid photo ID (passport or driving licence); and 
  • proof of address (recent utility bill or bank statement).
     

Both name and address must match the order details. If the purchaser is not present at delivery, we may be unable to complete delivery and the item may be returned pending rescheduling. 

13.4 Damaged Goods

Please check for damage before signing. If you sign to confirm damage, notify us immediately. You must notify us within 7 days of delivery. Regardless of insurance, we remain responsible for resolving damage issues. 

13.5 Faulty Goods on Arrival

Please inform us as soon as reasonably possible of any fault on arrival. We will resolve the fault at our cost. 

13.6 Warranty Terms (12 months)

We offer a 12-month warranty on Approved Used e-Bikes. This covers faults/defects in main components, including the frame, motor, battery, and electrics.

We may:

  • supply replacement parts;
  • provide advice on repairs;
  • repair the e-Bike at our premises; and/or
  • require the e-Bike to be returned to us for repair.
     

With our prior approval, you may use a local bicycle repairer. For higher-value repairs, we may require return to us for examination. For valid claims, we may reimburse shipping costs where the fault is covered. 

Exclusions
The warranty does not cover:

  • normal wear and tear;
  • faults caused by negligence or inadequate maintenance;
  • rust/corrosion caused by over-exposure to wet/moist conditions;
  • misuse or accidental damage;
  • consumables (tyres, inner tubes, brakes, brake pads, chain, bearings);
  • commercial use (courier/delivery services or private hire); or
  • modifications/alterations made after sale. 

13.7 Making a Claim

  • The warranty is not transferable and applies only to the original owner. Proof of purchase is required. 
  • The warranty runs from the date you receive the e-Bike and ends automatically 12 months later. 
  • Faults must be evidenced via photo/video so our technicians can verify them. 
  • We will decide whether repairs are carried out locally or by returning the e-Bike to us. 
  • For valid claims, we cover warranty shipping costs. 
  • Claim validity is determined at the sole discretion of eBikeBuyer. 

We decide what damage is due to defective materials and what is due to abuse or misuse.

Faults should be reported as soon as reasonably possible by phone or email. We may try to resolve issues without requiring return. Where appropriate, we may send replacement parts with guidance. If a fault is due to neglect or is not covered by the warranty, repairs will be charged at £35 per hour plus parts.

All products should be checked after delivery and before the first ride to ensure bolts/fixings have not loosened in transit. We recommend using appropriate safety clothing (e.g., helmets). Products must be used responsibly and not abused for the warranty to remain valid. 


PART D — LEGAL TERMS


14. Disclaimer Statement

We are not liable for losses that were not foreseeable to both parties when the Contract was formed, or losses not caused by a breach on our part. We are not liable for use of a product that does not comply with legislation in your region or jurisdiction.

Nothing in these Terms reduces your statutory rights relating to cancellation, faulty goods, or mis-described goods. For information about statutory rights, contact your local Trading Standards office or Citizens Advice. 

15. Trademark Disclaimer

eBikeBuyer.com is not associated with, affiliated with, or endorsed by any brands listed on the Website. Trademarks are used for identification and reference only. Warranties and customer support are provided by eBikeBuyer.com, not the trademark holders. 

16. Limitation of Our Liability

Nothing in these Terms limits or excludes liability for:

  • death or personal injury caused by negligence;
  • fraud or fraudulent misrepresentation; or
  • any other liability that cannot be limited or excluded under English law. 

To the extent permitted by law, we exclude all implied conditions, warranties, representations, or other terms that may apply to the Website or its content.

We are not liable for any costs, loss, or damage (whether in contract, tort, negligence, breach of statutory duty, or otherwise), even if foreseeable, arising from:
(a) use of, or inability to use, our Website;
(b) use of or reliance on content displayed on our Website;
(c) viruses or harmful material received through use of our Website or downloading content;
(d) use of third-party websites linked from our Website;
(e) booking, arranging, cancelling, or attending an Appointment. 

We are not liable for delays or failure to perform obligations due to events beyond our reasonable control.

Business users: We are not liable for loss of profits, sales, revenue, business interruption, anticipated savings, business opportunity, goodwill/reputation, or indirect/consequential loss.

Consumer users: We provide the Website for domestic and private use only. You agree not to use it for commercial purposes, and we are not liable for business losses. 

17. Your Liability

You agree to compensate us in full for any losses or costs (including reasonable legal fees) we incur due to:
(i) your breach of these Terms;
(ii) your unlawful use of the Website; or
(iii) your infringement of another person’s rights. 

18. Miscellaneous

  • If any part of these Terms is illegal or unenforceable, the rest remains in effect. 
  • You may not assign, sub-license, or transfer your rights or obligations under these Terms.
  • These Terms do not give rights to anyone who is not a party to them.
  • If we do not enforce a right immediately, we may still enforce it later. 

19. Applicable Law

These Terms and any dispute arising from them are governed by English law. The courts of England and Wales have exclusive jurisdiction.
