Our website has been designed to allow private individuals or businesses wishing to sell an electric bicycle or electric scooter ("eBike") on their own behalf (i.e. not as part of their own commercial activities) to obtain a valuation of their eBike and to provide them with the opportunity to sell the eBike to us.
In order to preserve and maintain the functionality of our Website and Services for everyone, there are a number of things you must not do. You must not:

You are responsible for making all arrangements necessary for you to have access to our Website and Services, including using your own virus protection software.
Use of our website is free of charge. We do not guarantee that our Website, Services, or any content we provide, will always be available without interruptions, or be bug, virus, fault or error free.
We do not guarantee that our Website will be secure or free from bugs or viruses. You should use your own virus protection software.
We may suspend, withdraw, discontinue or change all or any part of our Website, including your access to the Website, for any reason, at any time and without notice.

9. VALUATION AND PURCHASE (Electric Bikes)
Any valuation generated by www.ebikebuyer.com is based on the information you tell us about the “eBike” and on the following general assumptions we make about your eBike (the “Assumptions”):
You have the option at during the valuation process to amend any of the Assumptions and provide us with some further detail about your ebike.
We always carry out an inspection of your eBike before we offer to buy it. The initial valuation of your ebike may differ if any false or misleading information is provided, including any aspect of its history, condition, unusual features or customisation.
If, on inspection of the eBike, we consider that the value of the eBike is affected by any aspect of its history or condition, including any unusual feature or customisation or anything which affects or limits the Assumptions we made about the eBike, which was not apparent to us when we gave the Valuation, the price that we may be willing to pay for it following an inspection (the “Price”) is likely to differ from the Valuation.
How We Pay You
Our standard payment option is as follows:
- You will receive an initial deposit payment after successful inspection of your eBike. The eBike will then be listed and when sold, you will receive the guaranteed valuation amount with any deposit payment already paid deducted. If the eBike is not sold after 60 days of listing, you will automatically receive the guaranteed valuation figure with any deposit payment already paid deducted.
Our early payment option is as follows:
- If, at any stage you require funds sooner, we can offer you a lower early payment amount as an immediate total payment without having to wait for your eBike to sell. If you have already received an initial deposit, this amount will be deducted from the total payment. Once you have received the funds under the early option payment, the eBike is considered sold.
Price Guarantee
Subject to our inspection of the eBike, the Valuation is guaranteed for seven days from the date on which we send it to you.
If there is a significant price change within the 7-day guarantee period, we will use reasonable endeavours to contact you to let you know that the Valuation has changed.
Purchase Contract
A binding agreement to purchase the eBike 'the Contract' will only be made between us once it has been inspected by us and meets the criteria of the valuation.
Hand-over Requirements
At the time of making the Contract, we will expect you to provide us with:
We will also expect you to remove any personal possessions from the eBike once the Contract has been concluded. We will not be responsible for any personal items lost once the electric bike is in our possession.
If you fail to comply with these hand-over requirements, you agree that we have the right to withdraw any offer to buy the eBike with immediate effect, to rescind or terminate any Contract with immediate effect, and/or to indicate a revised Price at which we will be prepared to purchase the eBike. If we elect to rescind the Contract, we will return the eBike to you, and you will refund the Price to us.
Transaction Fees
There are no transaction fees.
Payment Options
Customers selling their eBike will receive payment via bank transfer only.
Payment is sent to their bank/building society immediately following inspection. It is possible that events beyond our control may delay payment, and if that happens we will not have any liability to you for the delay.
Mail-in Pack
If you have requested our mail-in pack this is provided free of charge on the basis that your eBike is submitted to us. Should you decide not to send your eBike to us for whatever reason, please return the pack to us or a fee of £29.99 will be charged (replacement cost). Return shipping costs of unused mail-in packs are the responsibility of the customer.
Cleaning
In order to offer a timely inspection and payment we require ebikes to be in reasonably clean condition. If your ebike is received in heavily soiled condition this will delay the inspection and we reserve the right to charge a cleaning fee of £40 which will be deducted from the valuation.
Time Limit for Mail-in Orders
All eBikes must be shipped to us within 10 days of receipt of the mail-in pack. Date of shipping is the date the courier collection has been arranged. Any eBikes shipped to us after this date will be subject to a re-valuation and the amount offered may need to be adjusted.
Cancellation
If we have received your eBike but it has not yet sold and you wish to cancel, we can return the eBike to you. We charge £79.99 which covers the return shipping, packaging and the initial courier collection costs of sending the bike to us originally. If you have received an initial payment this will need to be returned to us before we can despatch the eBike. If you have opted for the early payment option and received your funds, the eBike is considered sold and cannot be returned to you.

Payment Options
Customers selling their eScooter will receive an instant free bank transfer or Paypal transfer.
Customers choosing either option will have the payment sent to their bank/building society immediately after inspection of the eScooter has been completed. It is possible that events beyond our control may delay payment, and if that happens we will not have any liability to you for the delay.
10. USED ELECTRIC BIKE SALES
All our refurbished electric bikes are graded in terms of condition and come complete with battery, charger and keys (if applicable).
Refunds & Cancellation:
You may cancel your order within a 14 day ‘cooling off period’ after receiving the goods, This will then be subject to a full refund within 30 days of cancellation. The goods must be returned to ourselves Binty Trading LTD.
It is the buyers responsibility to return the goods to us, so please ensure you repackage the goods efficiently and take out courier insurance if returning by courier. We can also arrange the carriage back for you, but this is at a cost to yourselves. If the goods have not been returned within 21 days of cancellation we will take steps to recover the goods.
Delivery
Delivery is available to all mainland UK addresses. For more remote parts of Scotland an additional delivery fee may apply. Deliveries to Northern Ireland, Channel Islands and other offshore UK locations will incur additional delivery charges. Please contact us before placing your order to confirm what delivery charges (if any) will be applied.
Delivery is usually within 1-2 working days on all stock items. We will notify you if the delivery is going to take longer than this. Please contact us for additional postage charges if purchasing in more remote areas of Scotland.
Proof of Identity & Address
To prevent fraudulent transactions, we may require sight of original valid photo ID (Passport or driving licence) and proof of address (recent utility bill/bank statement) of the purchaser listed on the order before we handover your item. Both the name and address must match the details on the order. If the purchaser listed on the order is not present at delivery we may not be able to complete the delivery and the item will be returned pending a rescheduled delivery date.
Damaged Goods
Please check the delivery for damages before signing for the item in good condition. If you do sign as damaged please notify us immediately. However you have 7 days to notify us and regardless of insurance we will still bear the responsibility to rectify any damages.
Faulty Goods On Arrival
Please inform us as soon as reasonably possible of any fault with the product. We will then resolve the fault for you at our cost.
Warranty Terms
DURATION: We offer a 12 month warranty on all our refurbished electric bikes.
THE WARRANTY: Within the given warranty, we facilitate the supply of new parts and where appropriate advice on fixing the product, fix the product if brought to our premises or if necessary ship the product back to ourselves for repair. In some cases we will require the customer to ship the product back to us for examination and then we reimburse shipping costs if the fault does not come outside our warranty terms. Always save the shipping box, as this is required should the bike need to be collected under warranty.
EXCLUSIONS
MAKING A CLAIM
NOTE: We have the right to determine what damage is due to defective materials and what is due to product abuse or misuse.
FAULTS: Faults must be reported as soon as reasonably possible by phone or email. We will assess the problem and try to rectify without the need for you to send the product back to us to help save time. We will send out a replacement part, if possible, to be fitted by yourselves with guidance from us. If the problem is found to be due to neglect or not covered under the warranty then we shall fix the problem at a rate of £35 per hour plus the cost of replacement parts.
CONDITIONS: Upon purchase of all products, they must be thoroughly checked to ensure that no nuts or bolts have become loose or dropped out in transit. The same check should be carried out prior to each ride of the product, thus ensuring long-term durability. We advise that all products are ridden with adequate safety clothing ie; helmets etc. Products must be ridden in a responsible manner and must not be abused for the warranty to be valid. These are on-road vehicles and should be ridden with due care and attention for your own safety and that of the public.
DISCLAIMER STATEMENT: We will take no liability for losses that were not foreseeable to both parties when the contract was formed and for losses that were not caused by any breach on our part. We will take no liability for any use of a product that does not comply with current legislation relating to that product in your region or jurisdiction. By purchasing our products you have read and agreed to the terms and conditions set out Nothing in these terms will reduce your statutory rights relating to cancellation, faulty or misdescribed goods. For further information about your statutory rights contact your local authority Trading Standards Department or Citizens' Advice Bureau.

11. LIMITATION OF OUR LIABILITY
Nothing in these Terms excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.
To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to our Website or any content on it, whether express or implied.
We will not be liable to any user for any costs incurred, or loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or relating to:
(a) use of, or inability to use our Website;
(b) use of or reliance on any content displayed on our Website;

If you are a consumer user, please note that we only provide our site for domestic and private use. 12. YOUR LIABILITY
You will compensate us in full for any losses or costs, including reasonable legal fees, we incur because of (i) any breach by you of these Terms; (ii) your use of our Website in violation of any law; or (iii) infringement of the rights of another person.

If any term of these Terms is held to be illegal, invalid or otherwise unenforceable, the remaining parts of the Terms will continue to be enforceable.
You may not assign, sub-license or otherwise transfer any of your rights or obligations under these Terms to any other person.
These Terms do not give rise to rights that are enforceable by any person who is not part to these Terms.
If we do not exercise or enforce a right under these Terms against you at any time, this does not prevent us from doing so later.
14. APPLICABLE LAW
These Terms, its subject matter and its formation, are governed by English law. You and we both agree that the courts of England and Wales will have exclusive jurisdiction regarding these Terms and your access to and use of our Website (including any claims or disputes).
